These Terms of Service ("Terms") govern your use of TripXL's website, mobile application, and services (collectively, the "Platform") provided by TripXL Private Limited, a company incorporated under the Companies Act, 2013, with its registered office in Siliguri, West Bengal, India ("TripXL", "we", "our", "us").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Eligibility
You may use the Platform only if you:
- Are at least 18 years of age, or are using the Platform under the supervision of a parent or legal guardian
- Have the legal capacity to enter into binding contracts under applicable law
- Are not barred from using the Platform by any law
2. Nature of services
TripXL operates as an online travel intermediary. We display inventory from airlines, payment gateways, and other travel service providers. Our role is to:
- Search flight inventory and present options to you
- Facilitate the booking and payment process
- Issue the ticket (PNR) on behalf of the airline
- Provide customer support for the booking lifecycle
3. Your account
To make a booking, you must provide accurate, current, and complete information including:
- A valid mobile number and/or email address
- Passenger names exactly as they appear on government-issued ID
- Date of birth and other passenger details as required by the airline
- Valid payment method
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.
4. Booking process
A booking is confirmed only when:
- Payment is successfully captured by our payment gateway, AND
- The airline issues a valid PNR, AND
- You receive a confirmation email or SMS from TripXL
If any step fails, the booking is not valid even if money has been debited. In such cases, refunds are initiated automatically.
5. Pricing and payment
All prices on the Platform are inclusive of:
- Base airfare
- Applicable taxes and fees
- TripXL convenience fee (where applicable)
The final amount you pay is shown clearly before payment. Prices may change at any time before booking is confirmed. The price applicable to your booking is the one shown at the final review step before payment.

6. Cancellations and refunds
Cancellations are governed by our Cancellation Policy. Refunds are governed by our Refund Policy. Both are incorporated into these Terms by reference.
7. User obligations
When using the Platform, you agree to:
- Provide accurate passenger information matching your government-issued ID
- Comply with the rules of the airline you are flying with
- Arrive at the airport with sufficient time and valid documents
- Not use automated tools, scrapers, or bots to access the Platform
- Not attempt to circumvent any security or rate-limiting controls
- Not use the Platform for any unlawful, fraudulent, or harmful purpose
8. Prohibited conduct
You may not:
- Make speculative or fraudulent bookings
- Use stolen or unauthorized payment methods
- Misrepresent passenger details or use the Platform on someone else's behalf without authorization
- Attempt to manipulate prices, exploit pricing bugs, or claim unauthorized refunds
- Interfere with the operation of the Platform
Violations may result in booking cancellation, account suspension, and legal action.
9. Intellectual property
The Platform, its design, content, code, trademarks, and logos are the property of TripXL Private Limited or its licensors and are protected by applicable Indian and international intellectual property laws. You receive a limited, non-transferable, revocable license to use the Platform for personal, non-commercial purposes only.
10. Third-party services
Bookings made through TripXL are subject to the terms and conditions of the airline carrying you, payment gateways used for the transaction, and any other third-party service involved. TripXL is not responsible for the quality, safety, or reliability of services provided by third parties.
11. Limitation of liability

To the maximum extent permitted by applicable law, TripXL is not liable for:
- Flight delays, cancellations, schedule changes, or service issues caused by the airline
- Loss, damage, or theft of baggage
- Denied boarding due to invalid documents, missed check-in deadlines, or any reason within the passenger's control
- Visa or immigration issues
- Force majeure events (natural disasters, strikes, government actions, pandemics, war)
- Indirect, incidental, special, or consequential damages
Our total liability for any claim arising from these Terms is limited to the amount you paid TripXL for the specific booking that gave rise to the claim. ⚖ LEGAL REVIEW: verify enforceability under Indian Contract Act + Consumer Protection Act 2019
12. Indemnity
You agree to indemnify and hold harmless TripXL, its directors, officers, employees, and partners from any claim, damages, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any applicable law.
13. Privacy
Your use of the Platform is governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with the Digital Personal Data Protection Act, 2023.
14. Termination
We may suspend or terminate your access to the Platform at any time without notice if we reasonably believe you have violated these Terms or engaged in fraudulent activity. Termination does not affect bookings that have already been confirmed before termination, which remain subject to the airline's terms and our Cancellation Policy.
15. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Siliguri, West Bengal. ⚖ LEGAL REVIEW: confirm jurisdiction clause is valid given Section 28 of Indian Contract Act
16. Dispute resolution
Before initiating any legal proceeding, you agree to first contact us at grievance@tripxl.in and allow us 30 days to address your concern.
For consumer disputes, you may also approach the National Consumer Helpline (1915) or file at consumerhelpline.gov.in.
17. Grievance officer
In compliance with the Information Technology Act, 2000 and Consumer Protection Rules:

18. Changes to terms

19. Severability
If any provision of these Terms is found unenforceable, the rest of the Terms remain in full effect.
